This term of Use shows the “General Conditions” aplicable to usage of services offered by Bus Serviços de Agendamento Ltda., limited society, registered under the CNPJ nº 17.289.475/0001-42, with your headoffice located at Queiroz Filho Av, 1700 – Life Tower C, room 711, Postal Code 05019-000 by the name “CLICKBUS”, which includes the bus ticket scheduling and another services related to trips booked through the site www.clickbus.com.br/en and by the app for Android “CLICKBUS”, together denominated as “WEBSITE”.

This term is strictly validated according to the defense code statute of the consumer (Law 8.078/90) and Decree 7.962/2013. Any person, legally capable, defined as “CLIENT” that use “CLICKBUS” services, should accept this Term of Usage and all their principles and politics that govern It.

THE TERM OF USAGE IS INDISPENSABLE, being mandatory the UTILIZATION of Website services. The utilization of the services offered by “CLICKBUS” implies at a urgent consent/approval of this Term and your content. STILL IN CASE THE MINOR CHOOSE TO TRAVEL BY HIMSELF THE RESPONSABLE SHOULD REQUEST AN AUTHORIZATION AT THE COURT OF CHILDHOOD.

THE “CLIENT” BIGGER THAN 12 YEARS OLD CAN TRAVEL BY HIMSELF SINCE PROPERLY ACCOMPANIED AND WITH YOUR ID DOCUMENTS.

CONSIDERING THAT:

1.            “CLICKBUS” is specialized at online sales of bus ticket to the cities of São Paulo, Rio de Janeiro, Belo Horizonte, Brasilia, Goiânia, Curitiba, Florianópolis, Salvador beyond that, 3 (three) thousand destinations available offering comfort and convenience for those who travel by main bus lines of Brazil as Cometa, Garcia, 1001, Andorinha and more than 30 other partners. “CLICKBUS” is an facilitator service provider OF tickets purchase and does not make trips and/or does not have direct relations with “BUS LINES” registered inside our site.

2.            The  “CLIENT” is that one who will acquire all the bus tickets to the cities that “CLICKBUS” provides routes.

3.            ATENTION: THE “CLIENT” is aware that “CLICKBUS” doesn’t have any responsability since the moment of bus ticket purchase at the bus lines windows on the bus stations, being that but not limiting yourself to any lack of accuracy at the bus ticket emission damages/losses of luggage course acidentes detour of the route and/or any other damage that “CLICKBUS” is not involved directly.

4.            “BUS LINES” are companies that provides transportation services at bus stations, available at “CLICKBUS” database defined at main homepage of domain owned by “CLICKBUS” Website. The “BUS LINES” assume all the responsability for any damage since the bus ticket emission at the bus station windows.

5.            “ANTT”: The National Agency of Ground Transportation (ANTT) is a independent brazilian federal company responsable for the regulations of activities of rail infrastructure, federal bus station and service providers regarding ground transportation. ANTT has your own regulation e for your specification replaces the mandatory of your devices.

1.            TERMS AND UTILIZATION CONDITIONS

8.            “CLICKBUS” is free of any responsibility for any mistake or delay on the removal of prohibited content, ilegal or not permitted, provided or from third parts trough our Website. The “CLICKBUS” team can change at anytime and without any previous warning the content and features of Website.

9.            The acquisition services from the “CLIENT” will be finalized and accepted after payment is confirmed that will happen after service provided by the responsable company of payment management, once the same also provides your operations in an independente way.

3.            ABOUT THE INFORMATIONS ON SERVICE UTILIZATION

1.            “CLIENT” REGISTRATION

1.            Is not essencial condition to the “CLIENT” the choosed ticket purchase, is enough to follow the steps indicated at Website.

2.            When available by “CLICKBUS”, the “CLIENT” will be able to register and get the chance to enjoy special conditions to registered clients on this Website. The registration will be confirmed after the correct completion of all the requested data.

3.            Will not be allowed to the “CLIENT” have more than one register and in cases that occur, “CLICKBUS” will automatically disable all entries after verification of all data.

4.            All and any “CLIENT” minor than 18 years old should obtain mandatory authorization from your parentes or legal responsable before giving your e-mail adresses or any other data to “CLICKBUS”, trough this Website. 6.            “CLICKBUS” undertakes the responsability of not give in or comercialize under no reason, individual informations of the “CLIENT” registered without your mandatory authorization. 4.            THE STEPS TO BUY THE BUS TICKET

1.            To make the purchase of your bus ticket through “CLICKBUS” site, just follow the steps below:

1.            About preliminar informations:

1.            In first place, just fill up the origin fields, destination and trip day without the necessity of previous register.

2.            After the initial data filling, the “CLIENT” should choose for one of the Bus Lines available for that route according to prices and available time at the purchase moment.

2.            Seats Reservation:

1.            The “CLIENT” can make the reservation of your seat trough “CLICKBUS” site, however “CLICKBUS” won’t be responsable for the mistaken data inserted in the seats reservation. The “CLIENTS” are aware of the veracity and accuracy of personal data registered.

2.            The seats will be reserved only when the payment were completed, in case It doesn’t occur the bus ticket will be available for sale again and the seat will be opend to be taken by other “CLIENT”.

3.            The bus ticket should be with the name of the passenger that is going to travel with this is possible to get the ticket at the bus line window only showing the ID documents.

3.            The passenger data filling

1.            The “CLIENT” should fill your data correctly to have succes on the emission of the bus ticket to have a purchase validation by the credit card company, by the internal team of “CLICKBUS” and by the antifraud team.

2.            “CLICKBUS” will not be responsable for the wrong fill of the requested informations, aswell as the non approval by the “CLIENT” after checking of the requested documentation.

4.            The Payment

 

1.            TAXES AND PAYMENT WAYS

a.            Convenience tax charging

I.             To the service delivery of bus ticket purchase facilitation, “CLICKBUS” will charge a convenience tax. The convenience tax is delimited at the moment of the purchase on a clear way.

II.            All the successful transactions has an addition of taxes that will be charged by even by the Bus Line as by “CLICKBUS”.

III.          The taxes charged by the Bus Lines are: Toll, Taxes and Trip Insurance. These can change according to each bus line and route.

IV.          The convenience fee charged by “CLICKBUS” at the moment of bus ticket purchase regarding the service delivery, will not be returned to the “CLIENT” because the delivery service was already given to the “CLIENT”

IMPORTANT: ALL CHARGED TAXES WILL BE INFORMED AND DISCRIMINATED ON THE CONCLUSION SCREEN OF THE PURCHASE. BY CLICKING AT THE CONCLUSION BUTTON, THE CLIENT DECLARES HIMSELF AWARE OF THE CHARGED FEES E WON’T BE ABLE TO CONTEST THEM.

2.            Payment ways

i.             Credit Card

1.            “CLICKBUS” accepts all main credit card flags: VISA, MASTERCARD and DINERS. “CLICKBUS” will charge on your credit card bill immediately after the delivery of the request.

 

ii.            Bank Slip

1.            The payment option through BANK SLIP will be available only for trips made in advance according to what is fixed on the conditions of bank slip by choosing for this type of payment.

2.            After the bank slip expire date of payment, in case that the payment hasn’t been done the trip will be automatically canceled, and in case that the traveller has the intention to do this trip should make a new purchase, being aware of the possibility of not availability of the same ticket/ seat.

IMPORTANT: “CLICKBUS” reserves the right of exclusion of any payment way and using other methods of payment existing in the Market.

5.       APPROVAL PROCESS

1.            All the transactions made will run through an analisys and internal approval. After the analisys process is done, the “CLIENT” will receive on your e-mail the conclusion process information and in case the approval is confirmed will receive automatically the receipt of your trip.

2.            “CLICKBUS” will not guarantee at any moment that the delivery services by the responsable company for the payment management will work free of mistakes, interruptions, bad functioning, delas or other imperfections.

IMPORTANT: Purchases made using credit card can have an analisys deadline of up to eight hours. Purchases made by bank slip have a deadline of one working day to be processed after the payment is done.

3.            When accessing the informations of your purchase, the “CLIENT” will be able to see:

1.            CONFIRMED PURCHASE

 .             For all transactions confirmed, will be sent an approval e-mail with the receipt of purchase succesfull transaction. In case this e-mail were not found, check on your SPAM box.

2.            PURCHASES WITH PENDING ANALISYS

 .             Depending on the credit card history and of your owner or even the wrong input of purchase informations the transaction can be analised inside of an longer and detailed  process. When the process were finalized the “CLIENT” will receive an e-mail of confirmation with loc number or information of non approval of transaction.

3.            NOT APPROVED PURCHASES.

 .             The purchase not approved by the internal system of “CLICKBUS” through informations or granted processes by credit card company (because of internal politics that “CLICKBUS” have no access) will be automatically canceled and the information of non approval will be available at the payment page.

4.            PURCHASES NOT CONCLUDED

0.            In case the client doesn’t finish the purchase process, this will not be finished and the values of transactions won’t be charged/credited and the selected seats won’t be reserved.

6.            BUS TICKET PRINTING

1.            When concluding your purchase the “CLIENT” will receive an e-mail with payment confirmation and request summary with all the details about the trip.

2.            To print your bus ticket go to a bus line window with 1 hour in advance of boarding time, with your original ID with picture used at the moment of your seats reservation. Authenticated copies won’t be accepted.

5.            CHANGES AND TICKET CANCELATIONS.

1.            Is guaranteed to the “CLIENT” request the change of the boarding date or time directly at the bus line window by phone or in person with 3 (three) days in advance  from the confirmed boarding time.

1.            The boarding time change request depends on the bus ticket availability at date and time requested by the “CLIENT” being guaranteed to the “CLIENT”  the option for having open ticket regarding date and time, with an expiration date of 12 (twelve) months counted by the ticket purchase date being open to price readjustment.

2.            In case of ticket cancelation, will be necessary to request for It with a minimum time of 24 (twenty four) hours in advance,by e-mail directly with “CLICKBUS” through the attending center.

3.            The “CLIENT” has a deadline of 7 (seven) days, counting from ticket purchase to get into contact with “CLICKBUS” and use the right of regret, foreseen inside of the article 49 of the law 8.078/90. However the  ticket cancelation won’t be allowed after 24 (twenty four) hours before the boarding.

6.            TICKET REIMBURSEMENT

1.            Credit card

1.            The value return will be given according to transference from the credit card administrator.

2.            The value will be credited at the next credit card bill of the “CLIENT”, that may occur in 30 (thirty) or 60 (sixty) days.

2.            Bank Slip and Bank Transfer

1.            The “CLIENT” should get into contact with “CLICKBUS” through the link: https://clickbus.zendesk.com/hc/pt-br and inform your personal bank data, they are:

IMPORTANT: the reimbursement of the bank transfer will occur untill 5(five) working days.

1.            Full name of the bank account owner.

2.            CPF do titular da conta bancária.

3.            Bank/Agency/Account Number.

4.            Loc. Number

IMPORTANT: In terms of article 8º, §2º from resolution nº978 from ANTT, the transporter remain authorizes to retain untill 5% (five percent) of the value paid for the bus ticket, considered as compensatory fine in case of the passenger make the cancelation or transfer inside the deadline foreseen in the caput of this clause.

IMPORTANT: The convenience tax charged by “CLICKBUS” to make possible the service delivery, will not be returned because is a service already delivered to the “CLIENT”.

7.            LUGGAGE TRANSPORTATION

1.            According to what is available on the article 70 and following of Decret 2521/98 the price of the bus ticket covers as franchise the mandatory and free transportation of luggage being aware of the limits of weight and dimension.

1.            luggage compartment with 13,4 pounds of total weight and maximum volume of 9,84 feet is limited to the bigger dimension of any volume next to 3,28 ft and inside of package compartment, 11,02 lb of total weight with dimensions that is adaptable to the local since the comfort, safety and hygiene of the passengers don’t be affected.

2.            exceeded the franchise, the passenger will have to pay at least half percent of the price of bus ticket regarding the convencional service delivery by the transportation of each exceeded kilogram.

3.            Is forbidden the transportation of products considered dangerous indicated at specific legislation aswell as those that by your form and nature commit safety of the vehicule and of your passengers or third parts in terms of the article 72 from Decret 2521/98

8.            INTELLECTUAL PROPERTY

1.            The “CLIENT” agrees that the Website as logos, brands, insígnia, pictures, image, descriptions, texts, “layout”, symbol, signs, badge, manuals and any other material related  to the Website, are according this case copyright, business secrets, and/or rights of property of “CLICKBUS” or your licensors according to what was the case, and such rights protected by national and international legislation, applicable to intelectual property, specially when terms and conditions of Laws nº9.279/96, 9.609/98 and 9.610/98 and will not plead or complain at any time those rights of property as were them.

2.            Is expressly forbidden from the “CLIENT” the reproduction, distribution, modification, exhibition and development of works related to any type or utilization form of content of this Website and from your material show non the or by the Website.

9.            GENERAL CONSIDERATIONS

1.            The bus ticket correctly purchased is irrevocable in terms of Articles 427 and 429 of Civil Code of 2002, saving exceptional conditions.

3.            “CLICKBUS”        will not be responsable for expenses with freight in case occur the necessity.

4.            The “CLIENT” has a deadline of 7 (seven) days to get in contact explaining the reason for the trade or cancelation of your bus ticket reservation. However 48 (forthy eight) hours before the trip won’t be allowed anymore this change or cancelation.

5.            When inside of Website there are “links” to other sites, “CLICKBUS” recommends to the “CLIENT” make a research at respective “Use Policy” and “Terms of Privacy” on those Websites, aswell as any other specific regulation of each one, in case access these sites. “CLICKBUS” doesn’t make endorsement or guarantee or represent any third parts whose links are derivatives from the site, being sure that your disposable at the site intend to provide

6.            Certain acts, including, but not limited to use with ilegal purposes, information or data corruption, violation of industrial and copyright property, rights violation of third parts (including children), message sending with threatening, racista or porn content, interfering or interrupting the delivery service by the Site and/or any attempt of vírus spread or spread of undesired software can immediately result on the closure of relation between “CLICKBUS” and the “CLIENT”.

7.            Regarding of what is written at the Clause above the “CLIENT” agrees in having any information that has given or transmitted including any proposal to a question at any time without necessity of previous notification deleted from Website, at exclusive choice of “CLICKBUS” that still can have or maintain in your files a copy to appropriate actions without loss of any legal measure that is necessary. Such faculty is to protect interests from other “CLIENTS” aswell as from society as all, with interest in relieve risks inherent to those ilegal practices or contrary to use and local behavior.
